Drawing up a comprehensive development plan (CDP) is a statutory requirement under Sec.25 of the Karnataka Town and Country planning Act, 1961. Shortcomings in the current plan include widespread violation of building byelaws by house-owners and realtors, with the intention of subsequent regularisation by Muda and the city corporation. A report in The Hindu quoted the city corporation commissioner as saying that 90 percent city structures violated building bylaws, only to be regularised subseqently.
The CDP doesn't permit buildings taller than seven metres within a 100-metre radius of a notified heritage structure. The impunity with which this rule has been flouted can be seen in the structures all round Jaganmohan Palace. Under CDP 10 heritage structures and buildings have been notified as 'area of special control' that needs conservation in terms of environment and aesthetics. Focus groups such as MGP, INTACH and the Institute of Architects have listed 120 sites that deserve heritage treatment.
